Pleres Group LLLP ("Pleres") operates this website. Using it means you agree to these terms. If you don't, please don't use the site.
These terms govern your use of pleres.group. They do not govern any commercial relationship you have with Pleres; that relationship is governed by a separate signed agreement between you (or your organization) and Pleres or a Pleres affiliate. In the event of any conflict between these terms and a signed commercial agreement, the signed commercial agreement controls as to the subject matter it addresses; these terms continue to govern your use of the site.
What you can do here
Browse the site. Read what's published. Use the contact form to reach us for legitimate business reasons.
What you can't do here
- Scrape, crawl, or systematically extract content. Manual reading is fine; automated harvesting is not.
- Reverse engineer, decompile, or attempt to derive source code from the site or any service it depends on, except to the extent this restriction is prohibited by applicable law.
- Probe, scan, or test the vulnerability of the site or any related system, or breach any security or authentication measures, except under a written authorization from Pleres.
- Impersonate another person or organization in a contact-form submission.
- Use the site to do anything unlawful.
- Submit false or misleading information through the contact form.
What we own
The site, including all text, images, logos, marks, layout, and source code, is the property of Pleres Group or used by Pleres under license. "Pleres," "Pleres Group," and "Pleres Midstream," together with associated names, logos, and design elements used by Pleres on this site, are claimed as common-law trademarks of Pleres Group LLLP. We claim them in connection with midstream natural gas and related services in Texas, Oklahoma, and adjacent markets in which we operate. We make no claim, as of the date of this notice, to the word "Pleres" or any Pleres-prefixed name outside those operations. Other product, company, or service names mentioned on the site may be trademarks of their respective owners. Your use of the site does not grant you any license to any of those rights.
No warranty
The site is provided "as is." To the maximum extent permitted by law, Pleres disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade. We make no representations about the accuracy, availability, completeness, or reliability of the site, and may change, suspend, or remove content at any time without notice.
Illustrative descriptions
Descriptions of operating models, recovery methods, contract structures, indexing, and pricing on this site are illustrative of how Pleres structures work. They are not offers, quotes, guarantees of price, volume, recovery, or outcome, or commitments to deploy in any location. Actual terms are set only in a signed agreement, and figures vary per pad, basin, and counterparty. Nothing on this site is an offer to sell or a solicitation to buy any security or to participate in any investment.
Limitation of liability
To the maximum extent allowed by law, Pleres Group and its affiliates are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the site, regardless of legal theory and even if Pleres has been advised of the possibility of such damages.
Nothing in these terms excludes or limits liability for gross negligence, willful misconduct, or any other liability that cannot be excluded or limited under applicable law.
Dispute resolution
This arbitration provision is governed by the Federal Arbitration Act (9 U.S.C. §§ 1 et seq.). Any dispute arising out of or relating to these terms or your use of the site will be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will be conducted in Houston, Texas. The arbitrator's award is final and may be entered in any court of competent jurisdiction.
The arbitrator, and not any federal, state, or local court, has exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or any part of it is void or voidable.
You waive any right to bring or participate in a class, collective, consolidated, or representative action, whether in arbitration or in court. This waiver is a material part of the parties' agreement to arbitrate; if the waiver is held unenforceable as to any claim, that claim (and only that claim) shall be heard in the state or federal courts located in Harris County, Texas, and the remainder of this Dispute Resolution section shall remain in force as to all other claims.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles.
Changes
We may update these terms at any time. The "Last updated" date above reflects the current version. For material changes, including changes to the Dispute Resolution or Limitation of Liability sections, we will post notice on this page at least 30 days before the change takes effect. Continued use of the site after the effective date of any change means you accept the updated terms; if you do not agree, please discontinue use of the site.
General
If any part of these terms is held unenforceable, the remaining parts continue in full force, and the unenforceable part will be modified to the minimum extent necessary to make it enforceable. These terms, together with the separate signed agreement governing any commercial relationship with Pleres, are the entire agreement between you and Pleres concerning your use of the site, and supersede any prior or contemporaneous communications. Our failure to enforce any part of these terms is not a waiver of our right to enforce it later. You may not assign or transfer these terms; Pleres may.
